SERVICE TERMS AND CONDITIONS
DEFINITIONS:
Service: Shall include all forms of service, i.e Product Installation·, Product Return and After Service.
HappyWater: Happy Water Sdn Bhd
Customer: The person or organisation purchasing or renting Product.
Location: Shall mean the Installation Address as stated overleaf.
Product(s): Shall mean the product(s) specified overleaf
Services (i.e Installation, Product Return and After Service (“A/S”) (collectively, “Services”) shall be carried out by Personnel which are either:-
- authorised representatives of HappyWater;
- trained technical personnel; or
- appointed authorised & certified technical personnel within your region.
Customer shall grant to Personnel the right to full and free access of the Location to install and/or service the Product.
To the fullest extent permitted by applicable law, HappyWater shall not be liable to any person (whether Customer or a third party) for any loss of damage arising from the Services. This shall include, but shall not be limited to:
- any loss or damage to property including any pre-existing faults or damage to Customer’s property which HappyWater discovers while providing the services. HappyWater shall not be responsible for the cost of repairing any such pre-existing faults or damage; and
- any death or personal injury
which are not caused by HappyWater’s negligence or willful misconduct.
HappyWater shall have no liability to any person (whether Customer or a third party) for any indirect, general, special punitive, incidental, contingent or consequential damages, loss of income or profit howsoever arising, whether in contract or in tort (including negligence), even if HappyWater has been advised of the possibility of such damages.
Unless otherwise arranged and agreed upon, the Personnel shall carry out the services during normal business hours of 9:00am to 6:00pm from Monday to Saturday.
Customer shall ensure that an adult (someone at least eighteen (18) years of age) is present at the Location while the Personnel performs the Services. Customer shall keep children and all pets away from the service site to ensure that they do not interfere, impede or sustain injuries during the Services.
In the event that the Services cannot be performed onsite, HappyWater reserves the right to return the unit for service and/or repair at company workshop as stated overleaf. HappyWater shall have the sole discretion on whether to replace or repair the defective part(s) of the Product.
HappyWater will only provide the Services at the Location.
HappyWater will only provide Services at a location which is different from the Location if the Customer has obtained the prior written consent of HappyWater to the change of Location and/or user of the Product, which HappyWater may grant or refuse at its sole and absolute discretion, including but not limited to where the new location is an ‘off-road’ / ‘blockarea’ as determined by HappyWater. Without prejudice to the foregoing, HappyWater shall be ‘entitled to impose labour charges for each request to dismantle and/or reinstall the Product which shall be subject to labour charges even in the case of the first request, provided that in any case Customer shall be responsible for transporting the Product to the new location. Notwithstanding the foregoing, in the event the Customer moves the Product outside Malaysia, all services from and other obligations of HappyWater under the Agreement shall cease and the warranty in respect of the Appliance shall become void, without prejudice to the Customer’s obligation to settle all outstanding amounts owing to HappyWater.
HappyWater shall not be liable in any manner whatsoever for any losses or damages should there be any cancellation of scheduled maintenance service by the Customer. No additional maintenance service will be provided in replacement of the cancelled scheduled service.
Customer shall not perform or permit any unauthorised third party to perform any repair or maintenance services and, in any case, the Customer shall be liable for any damage to the Product as a result of any such services performed by Customer or any unauthorised third party.
In the event of product defect during the Warranty period, HappyWater reserves the right to repair or replace the Product at its discretion, including any filter change during regular maintenance. All replaced, defective or exchanged components shall remain as HappyWater’s property.
Customer agrees that any Product return request will result in immediate disposal by HappyWater. Any further request to return such Products will not be entertained. All other related terms & conditions as outlined in the product user manual and sales order form shall apply.
HappyWater shall not be liable for any loss or damage to the Product arising from any dismantlement of the Product and/or Product returns by the Personnel.
Upon signing of this Service form, Customer confirms that the Services have been performed to Customer’s satisfaction. In the event that Customer is not satisfied with the service rendered, Customer shall not sign this service form but shall call HappyWater Careline at 03-4043 4090 for further assistance.
